These terms are an agreement between you and inkynd ("inkynd", "we", "us"). By creating an account or using inkynd, you agree to them. If you don't agree, please don't use inkynd.
What inkynd is
inkynd is a local marketplace. People ("givers") buy items from participating businesses and leave them in a shared local pool. Other people ("claimers") can claim those items and redeem them at the business. inkynd is not a charity, and purchases are not donations.
Your account
- You need an account to use inkynd. There are personal accounts and business accounts.
- Give us accurate information and keep your login details secure.
- You're responsible for what happens on your account.
Shouting an item
- When you shout an item, you pay for it and it's added to the local pool for someone else to claim.
- Payments are processed by Stripe and are subject to Stripe's terms.
- You don't choose who claims your item, and claims are anonymous.
Claiming and redeeming
- You can claim one item at a time.
- A claimed item is held for you for one hour. If it isn't redeemed in that time, it goes back into the pool.
- To redeem, show your code at the business. Items must be redeemed at the business that listed them.
- Claimed items have no cash value and can't be sold, transferred or exchanged for cash.
For businesses
- You must be legally able to sell the items you list, and listings must be accurate.
- Please honour valid codes presented at your counter.
- You're paid for each item when it's redeemed, through Stripe.
- You're responsible for the goods and services you provide.
Fair use
Don't misuse inkynd. That includes creating fake accounts, gaming the pool, claiming items you don't intend to redeem, harassing anyone, or interfering with how inkynd works. We may suspend or close accounts that break these terms.
Our responsibility
Nothing in these terms limits your rights under the Australian Consumer Law. To the extent the law allows, inkynd isn't responsible for the goods or services provided by businesses, and our liability is limited to resupplying the service or paying the cost of doing so.
